Public Notice of Historic Use Applications filed with the District

Below is a list of applicants who have applied to the Post Oak Savannah Groundwater
Conservation District (POSGCD) for Historic Use of groundwater according to the Rules
of the POSGCD.  
POSGCD Rule 7.14 (7) states: It is the intent of the District to determine existing and
historic use of groundwater within the District as set forth under this rule.

POSGCD Rule 7.14(1) states: An owner of an existing non-exempt well that was
completed and operational prior to the effective date (March 9, 2004), and that
produced and used groundwater in any year during the existing and historic use period,
shall apply to the District for an historic use permit.  The application must be filed on or
before December 31, 2007.  Failure of an owner of such a well to apply for an historic
use permit on or before December 31, 2007, shall preclude the owner from making any
future claim or application to the District for an existing or historic use under these rules.
The failure of a well owner to file an application for an historic use permit on or before
December 31, 2007 shall cause the owner to forfeit his rights and ability to operate the
well under these rules, unless the owner thereafter applies for and obtains an operating
permit that authorizes production from the well.

POSGCD Rule 7.14(3) states: The District shall publish notice of the recommended
proposed permits or denials and make such recommendations available for public
review and inspection.  Any applicant or any affected party shall have 90 days from the
date of the above notice to file a request for hearing. The Board shall consider the
proposed historic use permit application and any other evidence presented by an
affected party prior to making its decision.

Below are links to lists of the recommended proposed Historic Use Permits
containing the following information: Name and address of the permittee, Location of
well, Use of the groundwater, and volume of production (volumes are stated in GPD
(gallons per day) or Acre Feet (acre feet per year; whereas one acre foot= 325,851
gallons). For any application the GPD may not accurately reflect the total use in acre
feet.

The field notes, maps and full request related to the above referenced applications and
public notices are available for inspection, review and copying at the Post Oak
Savannah Groundwater Conservation District offices, located at 310 E. Ave. C, Milano,
Texas.  Any applicant or any affected party must notify the General Manager in writing
within ninety (90) days of the date of this posting to file a request for hearing at P.O.
Box 92, 310 E. Ave. C, Milano, Texas 76556.  A copy of the documents and application
are available to the public during office hours from 8:00 a.m. until 4:00 p.m., Monday
through Friday.

The Board approved all applications except ALCOA's applications numbered
312 through 371. These applications were contested and finally settled at the
Board of Directors meeting of November 13, 2007.
